These Terms and Conditions ("Terms") govern the use of the Spice My Date app ("the App"), provided by generictec ("we"). By installing or using the App, you accept these Terms. If you do not agree, do not use the App.

1. Licence to use
We grant you a personal, limited, non-exclusive and non-transferable licence to install and use the App on your devices, for personal and non-commercial purposes, in line with these Terms and with the rules of the app store you got it from.
2. Account and eligibility
The App requires an account, created with an email and password or through Google or Apple. Before any account exists there is an age check: you must be at least 17 years old to use the App. That check is not an identity-verification mechanism: meeting this requirement remains your responsibility.
You are responsible for keeping your device and your account credentials secure.
3. Pairing
You can use the App without pairing. To send sneak peeks and share the weekly date, you pair your phone with someone else's through a pairing request. An account pairs with one person at a time, and a request can be accepted for 2 days.
By pairing, you confirm that you are doing so with an adult who consents to this use.
Either of you can undo the pairing at any time, without the other's permission. When that happens, anything neither side has opened yet is destroyed at that moment, both of you are told and are free to pair again. The same applies if you delete your account.
4. Subscriptions and purchases
The App is free to download and use: planning dates, getting ideas at the Cosy and Daring levels and, if you're in a relationship, a new idea every week. The Premium plan adds the Spicy level, every date pack, extra ideas with every weekly date and up to five photos in every sneak peek (one without Premium), and is available as a monthly or yearly subscription.
Prices are shown in your app store, in your currency and including applicable taxes, and may vary by region. Purchases are processed and billed by the App Store or Google Play and are subject to those platforms' terms. There is no free trial.
One subscription covers you both, on the dates you plan together, while you're paired. Your partner has Premium only on the dates you plan together and only while you're paired, and that access ends when the subscription ends. The subscription remains yours, tied to the store account you bought it with.
5. Renewal, cancellation and refunds
Monthly and yearly subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel renewal at any time in your App Store or Google Play account settings; Premium access continues until the end of the period already paid for. Refunds are handled by the app store, under its policies and your statutory rights as a consumer.
Reopening a sneak peek that expired before it was opened is a separate one-off purchase, sold by the App Store or Google Play at the price shown there. It reopens that one sneak peek once, for at most one day and never beyond the moment the server erases it, 10 days after it was sent. It is not a subscription, it does not renew and it does not grant or extend Premium. Refunds are handled by the app store, under its policies and your statutory rights as a consumer.
6. Acceptable use
Spice My Date exists for private use between consenting adults. You agree not to use the App to:
- create or share illegal content, in particular any child sexual abuse material, which is strictly prohibited and reported to the competent authorities;
- expose, photograph or record anyone who has not consented, or share intimate images of someone without their permission;
- harass, threaten, blackmail or impersonate anyone;
- copy, modify, decompile or reverse-engineer the App, except to the extent permitted by law, or bypass licensing or access mechanisms for paid features.
You are solely responsible for the content you send. The fact that a sneak peek is sealed for your partner and that we cannot see it does not authorise or protect any unlawful use: the law applies all the same. We may suspend or close accounts following reports of abuse or breaches of these Terms, and we may apply technical limits to prevent abuse.
The App lets you block and report whoever sends you a sneak peek, at any time.
7. Your content and sneak peeks
A sneak peek is ephemeral by design: it is destroyed once seen and, in any case, erased from the server 10 days after it was created. There is no album and no history, and we do not guarantee the recovery or retention of any content, or its delivery if the other person does not open the App in time. Dates, people and answers stay only on your phone: we hold no copy of them, so they are lost if you delete your data, uninstall the App or change phones.
The content you create remains yours. The processing of personal data is governed by our Privacy Policy.
8. Intellectual property
The App, the "Spice My Date" brand, the design, the code, the ideas and the date packs are the property of generictec and are protected by law. These Terms transfer no intellectual property rights to you, only the licence to use described above.
9. Disclaimer
Spice My Date is an app for planning dates. The ideas are suggestions: it is up to you to decide what you do, where and how far, and to stop whenever you want. Although we use strong encryption, no system is infallible, and security also depends on you keeping your device protected and trusting the person you pair with: whoever receives a sneak peek is viewing it on their own phone. The App is provided "as is", without warranties of uninterrupted availability, delivery or fitness for a particular purpose, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, generictec will not be liable for indirect, incidental or consequential damages, or for loss of data or content, arising from the use of or inability to use the App. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including your statutory rights as an EU consumer.
11. Changes to the App and the Terms
We may update, change or discontinue features of the App, including the ideas and the date packs, and we may revise these Terms. We will publish the revised version on this page, with the "Last updated" date. Continued use of the App after the changes take effect constitutes acceptance of them.
12. Service availability
We may suspend or limit the service, including the server that carries sneak peeks between devices, when necessary: a technical or security problem, a legal requirement, the failure of a supplier we depend on, or abuse that creates costs we cannot bear. We will restore the service as soon as reasonably possible.
While the service is interrupted, it may not be possible to pair, send or open a sneak peek, or get new ideas. Because content is ephemeral (section 7), a sneak peek that reaches its 10-day limit during an interruption is lost, and neither you nor we can recover it: we never hold the key.
If an interruption stops you from using Premium for a significant period, you are entitled to a refund for that time. Refunds are processed by the app store, under section 5. Nothing in this section affects your statutory rights as an EU consumer.
13. Governing law
These Terms are governed by Portuguese law. Disputes will be submitted to the competent courts of Portugal, without prejudice to the mandatory consumer-protection rules of your EU country of residence. The European Commission also provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
